A federal judge on Monday vacated President Donald Trump's policy imposing a $100,000 fee for employers' H-1B visa applications.
The visa payment policy violated the federal Administrative Procedure Act and the Constitution, Judge Leo Sorokin declared in the ruling in U.S. District Court in Massachusetts.
Sorokin (sounds awfully close to "Soros kin") cited John Roberts' ruling that called Obamacare a tax (even though Obama said it wasn't a tax).
Words have no meaning now. It's just "Democrat good, Republican bad."
The infinity immigration must continue unabated!
To be clear about the policy, there has ALWAYS been a fee for H-1B hires. It was just between $2,000-$5,000.
Donald Trump didn't invent the fee, he just increased it.
But this judge says that the fee, which has been in place since the program's inception, is now illegal and unconstitutional. Why? Well, because TRUMP.
Sorokin agreed with the 20 states that brought the suit in finding 'the substance and application of the $100,000 payment reveal that it is a tax' and that Congress had not delegated that power to the executive branch.
The Trump administration said it would appeal the ruling.
What a crazy ruling.
Does this mean that ALL visa fees are unconstitutional now?
What about other fees like driver's licenses and passport fees? Are those a tax too? Can I get my money back??
White House spokeswoman Taylor Rogers told CNBC in a statement after Monday's ruling, 'President Trump has clear legal authority to restrict entry of any class of aliens he determines is not in America's best interests, and that is exactly what he did.'
'The H-1B program has been abused for decades, and President Trump finally took action to fix it. A federal judge in Washington already upheld a nearly identical order, and the Administration is confident this order will be reversed on appeal,' Rogers said.
